Terms and conditions – N20 IMMOBILIER SARL

Available for consultation at the end of the form, before validation of the search mandate.

Preamble

N20 IMMOBILIER SARL (hereinafter ‘N20 IMMOBILIER’) assists its clients in finding and securing rental properties, whether residential or commercial.

By requesting our services, the Client accepts these General Terms and Conditions, which define the rights and obligations of each party in order to ensure transparent, respectful and effective collaboration.

Article 1 – Purpose of the Mandate

The Client mandates N20 IMMOBILIER to:

  • search for and present properties that meet their criteria;
    represent their interests with estate agents, landlords and owners;
  • prepare, complete and submit their application;
  • take all necessary steps to secure a property.

N20 IMMOBILIER undertakes to perform this mandate with diligence and professionalism, without transferring responsibility beyond the services defined.

Article 2 – Nature and Proof of the Mandate

This mandate is concluded on a non-exclusive basis. However, for any property presented, directly or indirectly, by N20 IMMOBILIER to the Client or to any other party, it is agreed that:

  • En cas de signature d’un bail portant sur ce bien, les honoraires convenus seront intégralement dus à N20 IMMOBILIER, quel que soit le mode ou la personne par laquelle la conclusion est intervenue ;
  • La preuve de la présentation pourra être établie par tout document ou élément écrit ou électronique transmis par N20 IMMOBILIER (courriels, fiches descriptives, annonces, photos, attestations de visite, messages électroniques, etc.).

Article 3 – Duration and Termination

  • Initial term: the mandate is concluded for three (3) months from the date of signature.
  • Renewal: tacitly renewed for one-month periods, unless terminated in writing.
    Termination by the
  • Client: by registered letter or email, with one month’s notice.
  • Termination by N20 IMMOBILIER: possible at any time, by written notification, particularly in the event of breach by the Client or inadequate conditions of collaboration.
  • Continuity clause: if, after termination, the Client enters into a lease for a property presented during the mandate, the fees remain payable to N20 IMMOBILIER.

Article 4 – Client Commitments

The Client undertakes to:

  • provide accurate information and authentic documents;
  • collaborate actively, diligently and willingly;
  • not negotiate or conclude directly with a landlord or property management company for a property presented by N20 IMMOBILIER;
  • behave respectfully and cooperatively during all procedures and visits.

In the event of serious breach or behaviour contrary to these terms and conditions, the Client shall be held solely liable and shall bear the legal and/or financial consequences thereof.

Article 5 – Fees and Payment

Fees are payable only in the event of success, i.e. the signing of a lease for a property presented by N20 IMMOBILIER.

  • Residential properties: 10% of the annual rent including charges, with a minimum of CHF 1,500.
  • Commercial properties: minimum flat rate of CHF 5,000 or one month’s rent including charges, whichever is higher.

Payment is due on the day the lease is signed. These fees correspond to the remuneration for a rental brokerage mandate within the meaning of Articles 412 et seq. of the Swiss Code of Obligations (CO).

Article 6 – Data Protection

The information provided is treated confidentially and used solely for the purposes of the mandate.

In accordance with the Federal Data Protection Act (FADP), the Client has the right to access, rectify or delete their data by contacting:

Article 7 – Responsability

N20 IMMOBILIER shall make every effort to achieve the objective of the mandate, but shall not be held liable for:

  • the rejection of an application by a property management company or landlord;
  • conditions imposed by landlords (bank guarantee, security deposit, special clauses in the lease, etc.);
  • subsequent disputes between the Client and third parties;
  • any event occurring after the lease has been signed (unpaid rent, damage, rental disputes, etc.).

Article 8 –  Conduct and Professional Relations

The Client undertakes to respect the image and professional relationships that N20 IMMOBILIER maintains with its partners (property management companies, landlords, owners, etc.).

Any direct contact with a landlord or partner concerning a property presented by N20 IMMOBILIER, or any behaviour that damages these relationships, will result in the full invoicing of the agreed fees.

Article 9 – Acceptance

By requesting the services of N20 IMMOBILIER, the Client acknowledges that they have read, understood and accepted these Terms and Conditions.

Signing the mandate confirms this agreement and authorises N20 IMMOBILIER SARL to take all necessary steps to search for and obtain a property.
