Scope of the Mandate

The Client mandates N20 IMMOBILIER to:

• search for and present properties matching the Client's criteria;
• represent the Client's interests with property managers, landlords and owners;
• prepare, complete and submit the Client's application file;
• undertake all steps necessary to obtain a property.

N20 IMMOBILIER undertakes to carry out this mandate with diligence and professionalism, without transferring liability beyond the defined services.

Nature and Proof of Mandate

This mandate is concluded on a non-exclusive basis. However, for any property presented, directly or indirectly, by N20 IMMOBILIER to the Client or to any other party, it is agreed that:

• In the event of the signing of a lease for that property, the agreed fees shall be due in full to N20 IMMOBILIER, regardless of the manner or the person through whom the conclusion was reached;
• Proof of presentation may be established by any written or electronic document or element transmitted by N20 IMMOBILIER (emails, property descriptions, listings, photos, visit certificates, electronic messages, etc.).

Duration and Termination

Initial duration:

the mandate is concluded for three (3) months from the date of signing.

Renewal:

tacit renewal for periods of one month, unless terminated in writing.

Termination by the Client:

by registered mail or e-mail, with one month's notice.

Termination by N20 IMMOBILIER:

possible at any time, by written notice, in particular in the event of a breach by the Client or inadequate conditions of collaboration.

Continuity clause:

if, after termination, the Client concludes a lease for a property presented during the mandate, fees remain due to N20 IMMOBILIER.

Client Obligations

The Client undertakes to:

• provide accurate information and authentic documents;
• collaborate actively, with diligence and availability;
• not negotiate or conclude directly with a landlord or property manager for a property presented by N20 IMMOBILIER;
• adopt respectful and cooperative behaviour in all procedures and visits.

In the event of a serious breach or behaviour contrary to these terms, the Client shall be solely responsible and shall bear the resulting legal and/or financial consequences.

Fees remain fully due and acquired by the agency upon signing of the lease. They shall not be refunded in the event of contract termination resulting from a breach by the Client or the non-viability of their file discovered after signing.

Fees and Payment

Fees are due only upon success, i.e. the signing of a lease for a property presented by N20 IMMOBILIER.

Residential properties:

One month's rent including charges per signed lease, with a minimum of CHF 1,500.–

Commercial properties:

minimum flat fee of CHF 5,000.– or one month's rent including charges if greater.

Payment is due on the day of lease signing. These fees correspond to the remuneration of a rental brokerage mandate within the meaning of Articles 412 et seq. of the Swiss Code of Obligations (CO).

Data Protection

Information provided is treated confidentially and used solely within the scope of the mandate.

In accordance with the Federal Act on Data Protection (FADP), the Client has the right of access, rectification or deletion of their data by contacting: contact@n20immobilier.ch

Liability

N20 IMMOBILIER makes every effort to achieve the mandate's objective, but cannot be held responsible for:

• the rejection of an application by a property manager or landlord;
• conditions imposed by owners (bank guarantee, security deposit, special lease clauses, etc.);
• subsequent disputes between the Client and third parties;
• any event after the lease signing (unpaid rent, damage, tenancy disputes, etc.).

Professional Conduct and Relationships

The Client undertakes to respect N20 IMMOBILIER's image and professional relationships with its partners (property managers, landlords, owners, etc.).

Any direct contact with a landlord or partner regarding a property presented by N20 IMMOBILIER, or any behaviour that damages these relationships, will result in the full invoicing of the agreed fees.

Acceptance

By engaging N20 IMMOBILIER's services, the Client acknowledges having read, understood and accepted these Terms and Conditions.

Signing the mandate confirms this agreement and authorises N20 IMMOBILIER SARL to take all necessary steps in the framework of the property search and acquisition.
